These Terms of Service explain the terms that apply when you visit makingtocreate.com, use our services or purchase a product from us.
The website and store are operated by Make to Create Ltd, trading as Making To Create (“Making To Create”, “we”, “us” or “our”). Our online store is powered by Shopify.
By using our website or placing an order, you agree to these Terms of Service together with our Privacy Policy, Shipping Policy and Refund Policy.
Nothing in these Terms limits or excludes any rights you have under applicable consumer law.

2. Using Our Website
You must use our website only for lawful purposes.
You must not:

You are responsible for ensuring that information you provide is complete, current and accurate.
If you create an account, you are responsible for keeping your login details secure and for activity carried out through that account.
3. Products
We make reasonable efforts to describe and display our products accurately.
Because many products are handmade and personalised, slight variations may occur between:

Website photographs and the finished item.

Colours displayed on different screens.

Printed colours and digital proofs.

The placement, shape, size or cropping of personalised elements.

Individual handmade items.
These minor variations are part of the handmade process and do not normally mean that a product is faulty.
Product photographs may include props or decorations that are not included unless stated in the product description.
Product availability, descriptions, options and prices may be changed or withdrawn without notice. Changes will not affect an order we have already accepted unless agreed with you or required to correct an obvious error.
4. Orders
Placing an order is an offer to purchase the selected products.
After ordering, you should receive an automated order confirmation. This confirms that we have received your order but does not necessarily mean that all requested personalisation can be completed.
We may contact you if:

Information or photographs are missing.

A photograph is unsuitable.

A requested design cannot reasonably be produced.
-
There is a pricing or product-description error.
-
An item is unavailable.
-
We cannot meet an essential timescale disclosed before ordering.

We reasonably believe an order is fraudulent or unlawful.
If we cannot accept or complete an order, we will contact you and arrange an appropriate refund for any amount paid.
Please review your order details, delivery address, quantities and product options carefully before completing payment.
5. Sending Photographs and Instructions
After ordering, send your photographs to maketocreate@gmail.com.
Please include your name and Shopify order number in the email subject so that the photographs can be matched to your order.
Use the “Order special instructions” box at checkout to provide written details, including:

Your celebration date.

Required wording or age.
-
Party-hat or design choices.
-
Preferred colours or theme.
-
Any other relevant requests.
Photographs cannot be attached through the checkout instructions and must be emailed separately.
Processing may be delayed until all required photographs and instructions have been received.
6. Photograph Requirements
For the best results, provide a clear, high-quality image showing the full face and hair.
Avoid:

Screenshots or compressed social-media images.
-
Heavy filters.
-
Strong shadows.
-
Blurred or very small photographs.
-
Images where part of the face, head or hair is cropped.
-
Photographs in which the subject is difficult to distinguish.
The finished quality depends partly on the quality of the photograph supplied.
We may make reasonable edits such as removing the background, adjusting the crop and preparing the photograph for print. We cannot guarantee that a poor-quality photograph can be made completely clear.
If you are unsure whether a photograph is suitable, contact us before ordering.
7. Permission to Use Photographs
By supplying a photograph, you confirm that:

You have the right and permission to provide it.

Its use for your order does not infringe another person’s copyright, privacy or other rights.

Where it shows a child, you are the parent or legal guardian or have permission from the parent or legal guardian.

You authorise us to edit and use it solely to create your proof, personalised product and related customer service.
Supplying a photograph for an order does not give us permission to publish it, post it on social media or use it in advertising.
Customer photographs or finished artwork will only be used publicly where appropriate permission has been obtained.
Our handling and retention of photographs is explained in our Privacy Policy.
8. Personalisation and Proofs
A digital proof will normally be prepared within 1–3 working days after we receive the photographs and information needed for the order.
You are responsible for checking the proof carefully, including:

The photograph and cropping.

Names, ages and other wording.
-
Spelling and punctuation.
-
Colours and decorative elements.
-
Quantities and design variations.
-
Any other requested personalisation.
You may request reasonable changes before approving the proof.
Once you approve a proof, production may begin immediately and further changes may not be possible.
If we do not receive a response within 24 hours, we may continue with the design shown to prevent the order from being delayed.
We cannot normally offer a refund or free replacement for an error that was clearly visible in an approved proof, unless the finished product differs materially from the approved design. This does not affect your statutory rights where a product is faulty, not as described or otherwise does not meet legal requirements.
9. Prices and Payment
Prices are displayed in the currency shown on the website.
The total cost, including applicable delivery charges, will be shown before payment is completed.
International customers may be responsible for customs duties, import taxes or other charges imposed by their country. These charges are not controlled by Making To Create and are not included unless expressly stated.
Payment is processed securely through Shopify and its available payment providers.
We may correct an obvious pricing error. If an incorrect price affects an order you have placed, we will contact you before proceeding and give you the option to pay the correct price or cancel for a refund.
Promotional codes and discounts:

Must be entered before checkout is completed.

Cannot normally be applied retrospectively.
-
May have expiry dates, minimum spends or product exclusions.
-
Cannot be exchanged for cash.
-
May not be combined unless expressly permitted.
10. Processing Times
Personalised orders normally require 2–5 working days to prepare before dispatch.
This timeframe begins once we have received the required photographs and personalisation information. Proof approval or missing information may affect the processing time.
Processing times are estimates and may vary depending on product type, quantity, complexity and seasonal demand.
If you require an order for a particular date, contact us before ordering so we can confirm whether the requested timescale is achievable.
11. Shipping and Delivery
UK orders are normally dispatched using Royal Mail Tracked 48. Royal Mail aims to deliver Tracked 48 parcels within 2–3 working days after dispatch, but this is not a guaranteed delivery service.
International orders are sent using a tracked service. International delivery times vary depending on destination, carrier and customs processing.
Making To Create currently ships within the UK and internationally, excluding European countries outside the UK.
Tracking information will be provided where available.
Delivery dates are estimates unless we expressly agree to use a guaranteed service. We are not responsible for delays caused by postal services, customs, adverse weather or other events outside our reasonable control, but this does not affect our responsibilities under applicable consumer law.
Please provide a complete and accurate delivery address. Contact us immediately if you notice an error. We cannot guarantee that an address can be changed after dispatch.

12. Event Dates
Providing an event date helps us understand your deadline, but it does not create a guaranteed delivery date.
Customers are responsible for ordering with sufficient time for:

Photograph submission.

Proof preparation.

Requested changes.
-
Production.
-
Dispatch and delivery.
If an order is time-sensitive, contact us before purchasing. We will advise honestly whether the timeframe appears achievable, but postal delays can occur outside our control.
13. Cancellations, Returns and Refunds
Most Making To Create products are personalised or made to the customer’s specification.
Because personalised products cannot normally be resold, they cannot usually be cancelled, returned or refunded simply because the customer has changed their mind.
If you wish to cancel, contact us immediately. If editing, proof preparation, printing or production has not started, we will do our best to help. Once personalised work has begun, cancellation may not be possible.
Eligible non-personalised goods may be cancelled and returned in accordance with our Refund Policy and applicable consumer law.
If an item arrives faulty, damaged, incorrect or materially different from its description or approved proof, contact us at maketocreate@gmail.com with:

Your name and order number.

A description of the problem.

Clear photographs of the product and packaging.
We will review the issue and arrange an appropriate remedy, which may include repair, replacement or refund.
Nothing in these Terms or our Refund Policy limits your statutory rights.
14. Digital Products
Where a product is supplied digitally, the product description will explain what is included and how it will be delivered.
Unless a product listing expressly grants broader rights, digital products are supplied for the customer’s personal use only.
Digital files must not be:

Resold or redistributed.

Shared with others.
-
Uploaded to file-sharing services.
-
Reproduced for commercial sale.
-
Altered and sold as a new product.
-
Used in a way that infringes another person’s rights.
Where you expressly consent to receive digital content immediately and acknowledge that downloading or accessing it will end your statutory cancellation right, the order cannot normally be cancelled after access or download has begun.
If a digital file is faulty, corrupted or materially different from its description, contact us so we can provide an appropriate solution.
Any specific licence included in a product listing will take priority over the general personal-use licence above.
15. Intellectual Property
The website and its original content—including our branding, logos, product designs, graphics, illustrations, photographs, text and layouts—belong to Make to Create Ltd or are used with permission.
You may browse the website and download or print order-related material for personal use.
You must not copy, reproduce, modify, distribute, republish, sell or commercially exploit our website content or designs without written permission.
Purchasing a physical or digital product does not transfer ownership of our underlying designs, templates, graphics or intellectual property.
Customer ownership of an original photograph does not grant ownership of our separate design elements, illustrations, templates or branding.
16. Reviews and Feedback
If you submit a review or publish one through a connected sales platform, you confirm that it reflects your genuine experience and does not contain unlawful, abusive or infringing material.
Reviews imported from Etsy may be displayed through Shuttle or another review service.
We may display genuine reviews on our website in accordance with applicable law and our Privacy Policy. We will not treat photographs privately emailed for order fulfilment as marketing material or public feedback.
We may remove or decline to display content that is unlawful, misleading, abusive, irrelevant or infringes another person’s rights.
17. Third-Party Services and Links
Our store is powered by Shopify and may use third-party providers for payments, delivery, analytics, reviews and other store functions.
Third-party services are governed by their own terms and privacy policies. We are not responsible for websites or services operated independently by third parties.
Links to other websites are provided for convenience and do not necessarily constitute an endorsement.
Sales made through this website are made directly between you and Make to Create Ltd. Shopify is not the seller of our products.
18. Website Availability
We aim to keep the website accurate, secure and available, but we cannot guarantee uninterrupted or error-free access.
We may temporarily suspend, restrict or change parts of the website for maintenance, security, legal or operational reasons.
We may correct typographical errors, inaccurate product information, pricing errors or omissions when identified.
19. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

Death or personal injury caused by negligence.

Fraud or fraudulent misrepresentation.

Breach of rights that cannot legally be excluded.

We are not responsible for delays or failures caused by events outside our reasonable control. If such an event significantly affects an accepted order, we will contact you and take reasonable steps to minimise the disruption.

The Privacy Policy explains how we handle customer details, emailed photographs, personalised artwork, order information, cookies and data shared with service providers.
21. Changes to These Terms
We may update these Terms to reflect changes to our services, business practices or legal obligations.
The latest version will be published on this page with an updated revision date.
Changes will not retrospectively remove rights that already apply to an accepted order.
22. Governing Law
These Terms are governed by the laws of England and Wales.
If you are a consumer living elsewhere in the UK, you may also benefit from mandatory protections and may bring proceedings in the courts available under applicable consumer law.
Nothing in this section removes any mandatory rights available to you based on where you live.
